JOMBANG, SWARAJOMBANG.com – Aliansi Lembaga Swadaya Masyarakat Jombang dalam minggu ini berencana audiensi ke Kantor Satpol PP untuk menindaklanjuti tuntutan terkait penutupan bangunan tidak berizin di Jombang.
Tujuan audiensi adalah untuk meminta Satpol PP agar melakukan inventarisasi bangunan yang belum memiliki Persetujuan Bangunan Gedung (PBG).
“Kami yakin Satpol PP minimal punya peta itu (bangunan tidak berizin) dan nanti Satpol PP akan kita ajak sharing teknis pemetaan bangunan tak berizin,” ungkap Lutfi Utomo Koordinator Aliansi.
Ditambahkan Lutfi, bahwa Aliansi nanti akan membantu Satpol PP di lapangan dengan cara mencari titik koordinat seluruh bangunan yang dicurigai tidak mengantongi izin bangunan.
“Selain dengan Satpol PP, Aliansi juga akan menggandeng bagian Tata Ruang Dinas PUPR Jombang untuk cross check data agar hasil temuan di lapangan menjadi legitimit,” sambung Suhartono, anggota Aliansi lainnya.
Lebih lanjut dikatakan oleh Suhartono yang juga Ketua LSM LPKRI, apabila bangunan tidak ada kesesuaian dengan tata ruang dan melanggar perizinan yang lain maka akan kita sampaikan ke Satpol PP untuk ditindaklanjuti.
Apa yang direncanakan oleh Aliansi LSM Jombang tersebut memang bagian dari upaya penegakan hukum terkait perizinan di kota Jombang.
Seperti diketahui, fenomena penegakan hukum yang lemah di sektor perizinan di Jombang sempat menjadi sorotan publik.
Pelanggaran hukum yang dilakukan para investor dalam melakukan pembangunan, khususnya di sektor industri di Jombang terlihat sangat masif.
Para pengusaha besar dalam melukukan investasinya di Jombang seringkali melanggar regulasi tentang perizinan.
Akibatnya, dengan tanpa mengantongi perizinan, mereka membangun tanpa menghiraukan aspek teknis perencanaan, pelaksanaan, pengawasan dan keselamatan dengan baik.
Pelanggaran standart mutu konstruksi tersebut masih dalam satu aspek teknis bangunan saja, belum menyangkut aspek lainnya yang dilanggar.
Apabila kita berhitung pada aspek lingkungan hidup, ada dampak yang berisiko pada rakyat kecil apabila izin dampak lingkungan dilanggar.
Contoh kasus pelanggaran lingkungan hidup pada pembangunan pabrik plastik PT Kema Sejahtera di Kabuh.
Lahan petani di sekitar pembangunan pabrik terdampak banjir, air menggenangi persawahan karena diduga ada penyumbatan pada saluran irigasi serta tertutupnya saluran pembuangan.
Di hadapan Kasat Pol PP yang sedang menyidak lokasi pembangunan pabrik yang tidak berizin seorang petani sempat menyampaikan keluhannya.
“Kemarin tanaman jagung saya mati gara-gara terendam air. Sekarang ganti tanaman padi yang tenggelam,” keluh petani.
Masih terkait dampak dari pembangunan PT Kema Sejahtera di Kabuh yang tanpa izin. Mereka membangun tanpa etika dengan “mencaplok” wilayah sungai milik Balai Besar Wilayah Sungai (BBWS) Surabaya kurang lebih separuh dari lebar sungai.
Adapun dampak yang ditimbulkan dari penyempitan sungai akan berpengaruh pada debit air yang mengalir ke sawah petani serta terhambatnya arus air.
“Dari contoh kasus tersebut, ternyata ada nilai yang wajib kita jaga dan pelihara. Esensi dari sebuah perizinan bangunan industri dibutuhkan adalah untuk melindungi hak, kenyamanan, keselamatan serta adanya kepastian hukum pada Rakyat,” papar Suhartono.
Ditambahkan Lutfi, apabila Pemerintah tidak mampu membaca nilai tersebut dengan baik, maka sebutan rakyat sebagai subyek pembangunan oleh pemerintah hanyalah sebuah retorika.
